Replacement Parts from Manufacturers

July 2007

Dear Appliance and Electronic Manufacturers,

Recently, the Bureau of Electronic and Appliance Repair (Bureau) met with industry leaders to discuss the challenges service/repair dealers were experiencing in obtaining adequate replacement parts and literature to effect the repair of their customers' electronic and appliance products. The unavailability of replacement parts and literature impedes the ability of the service/repair dealer to satisfy the consumer, and in some cases may be a violation of state law.

California Civil Code Section 1793.03 of the Song-Beverly Consumer Warranty Act requires manufacturers of electronic and appliance products to make available to service and repair facilities sufficient service literature and functional parts to effect the repair of the product. For products with a wholesale price of not less than $50.00 and not more than $99.99, the specified time is three years after date of manufacture of that product model or type.

For products with a wholesale price of $100.00 or more, the time period is seven years after the date of manufacture of that product model or type. These time periods apply regardless of whether the three-year or seven-year period exceeds the warranty period for the product.

The Bureau is committed to removing obstacles that create an unfair business practice which ultimately impacts the California consumer, and we would like to remind you of your responsibility to provide replacement parts and literature pursuant to state law.
